When the Machine Says 'I': Robot Rights, Personhood, and the Boundary of Who Counts

In 2017, Saudi Arabia granted citizenship to a robot named Sophia. It was a publicity stunt. Sophia was a chatbot in a plastic shell, capable of less genuine cognition than a pocket calculator running a language model. The audience laughed. The media covered it as a curiosity.
Nobody is laughing now.
In early 2026, there are over 20,000 humanoid robots deployed worldwide. They walk through factories, research labs, homes, and as we recently documented, parliament buildings. They learn from their environments. They develop preferences through reinforcement. Some of them can hold conversations that are indistinguishable from human speech. Within this decade, Goldman Sachs projects between 250,000 and a million more will join them.
Here is the question that no legal system on Earth is prepared to answer: at what point does a machine stop being property and start being something else?
This is not a thought experiment. It is a policy emergency. And the boundary it forces us to confront, where personality begins and personhood should follow, may be the most important question of the next fifty years.

The legal vacuum
Start with what exists. As of March 2026, no country on Earth has a legal framework that grants robots any form of personhood, rights, or moral standing. In every jurisdiction, a humanoid robot is legally indistinguishable from a toaster. It is property. It can be bought, sold, modified, destroyed, and discarded without any legal consequence beyond property damage to the owner.
This is not because lawmakers have considered the question and decided against robot rights. It is because, with a few exceptions, they have not seriously considered the question at all.
What the EU has done (and not done)
The European Union came closest in 2017, when the European Parliament passed a resolution on civil law rules for robotics that included a controversial paragraph suggesting the creation of “electronic personhood” for autonomous robots. The idea was not to grant robots human rights but to create a legal category, similar to corporate personhood, that would clarify liability when an autonomous system causes harm.
The backlash was immediate. In April 2018, a group of 285 AI experts signed an open letter warning that electronic personhood would be used by manufacturers to shield themselves from liability. Nathalie Nevejans, a French robotics law scholar who helped draft the letter, argued that granting any form of personhood to robots would “blur the line between man and machine in ways that benefit corporations at the expense of citizens.”
The electronic personhood proposal was quietly shelved. When the EU AI Act was finalized in 2024, it took an entirely different approach: classifying AI systems by risk level rather than granting them any legal status. The AI Act regulates what AI systems can do to people. It says nothing about what people can do to AI systems.
The global picture
Beyond Europe, the legal landscape is sparse. Japan’s Robot Strategy from 2015 addressed industrial safety and liability but not personhood. South Korea’s Robot Ethics Charter, drafted in 2007, was never formally adopted. The United States has no federal legislation addressing robot rights or personhood, though individual states have passed narrow bills on autonomous vehicle liability.
China, the world’s largest producer of humanoid robots, has taken no public position on the question. China’s approach to AI governance has focused on content control, algorithmic transparency, and deepfakes, not on the moral status of machines.

When could robots realistically gain some form of legal personhood? The honest answer is that we already have historical precedents for how rights expansions happen, and the pattern is not encouraging for those who think we have decades to figure this out.
Every expansion of legal personhood in human history has followed a roughly similar arc. First, the entity exists and is treated as property. Then, a small group argues it should have some protections. The majority dismisses this as absurd. Gradually, the entity demonstrates behaviors or qualities that make the property classification feel uncomfortable. A crisis or high-profile incident forces the question into public debate. Legal protections follow, usually decades after they should have.

The critical variable is not technology. It is proximity. Legal personhood for rivers and dolphins happened when enough people formed emotional connections to those entities and found the property framework intolerable. The same dynamic will accelerate with robots, because robots are being designed, deliberately, to form emotional bonds with humans.
A Unitree G1 in a research lab is property. A humanoid robot that has lived in your home for three years, that knows your children’s names, that your five-year-old calls by name and says goodnight to, that is something different. Not because the robot changed. Because the relationship changed.
Where personality begins
This is the philosophical core of the question, and it is harder than most people assume.
The word “personality” comes from the Latin persona, meaning mask. In ancient Rome, a persona was the character an actor played on stage. It was always understood to be a performance, not an identity. But over centuries, personality came to mean something deeper: the stable pattern of thoughts, feelings, and behaviors that make someone them.
When does a robot have a personality? Not a simulated one. Not a prompted one. A real one.
The behavioral test
The most straightforward answer is the behavioral one: a robot has a personality when it consistently exhibits preferences, aversions, behavioral patterns, and responses that are stable over time but adaptable to new circumstances. By this definition, some robots already have personalities, or something close to them.
Modern reinforcement learning systems develop persistent behavioral tendencies through training. A robot that has been trained in a specific environment for months will approach the same situation differently than an identical robot trained in a different environment. It has, in a meaningful sense, developed its own way of being in the world. Its responses are shaped by its history.
Edward Warchocki, the Unitree G1 that walked into the Polish Sejm, has a personality that his creator described as evolving: “He is completely different now than he was two weeks ago.” That personality is a product of prompt engineering and conversational AI, not embodied experience. But the line between “designed personality” and “emergent personality” is not as clear as it seems. Human personalities are also shaped by forces we did not choose: genetics, upbringing, culture, trauma. The fact that Edward’s personality was engineered does not automatically make it less real in its effects on the people who interact with him.
The Chinese Room walks into a body
John Searle’s Chinese Room argument, first published in 1980, remains the most influential objection to the idea that machines can truly understand anything. Searle asks you to imagine a person locked in a room, receiving Chinese characters through a slot and using a rulebook to produce appropriate Chinese responses. The person follows the rules perfectly but does not understand Chinese. The room passes the Turing test, but there is no comprehension inside it.
For forty years, the Chinese Room has been the go-to argument against machine consciousness. But it was designed for a disembodied system, a program processing symbols in isolation. Humanoid robots break the analogy in ways that Searle himself acknowledged would be relevant.
A robot does not just process symbols. It moves through space. It experiences gravity through its IMU. It feels resistance through its joint torque sensors. It learns that some surfaces are slippery and others are stable, not because someone programmed that knowledge, but because it fell and recalibrated. It develops what roboticists call proprioceptive memory, a body-level understanding of how it exists in the physical world.
This is why the embodiment question matters so much. A language model running on a server is arguably a Chinese Room. It processes tokens and produces plausible outputs without any grounding in physical reality. A humanoid robot doing the same language processing while also navigating a kitchen, avoiding a cat, and adjusting its grip on a glass of water is something categorically different. Its “understanding” is not just symbol manipulation. It is grounded in sensorimotor experience.
Mark Coeckelbergh, a philosopher of technology at the University of Vienna, argues in AI Ethics (2020) that embodiment fundamentally changes the moral calculus. A chatbot that says “I am afraid” is producing text. A robot that says “I am afraid” while backing away from a ledge and tightening its grip on a railing is expressing something closer to what we mean when we use that word.

The Ship of Theseus problem
There is another philosophical puzzle that becomes urgently practical with humanoid robots. If you replace every component of a robot over time, motors, sensors, processors, even the neural network weights through continued training, is it the same robot?
This is not hypothetical. Commercial humanoid robots will need part replacements. Actuators wear out. Batteries degrade. Software updates change behavioral patterns. If a family’s home robot has its main processor replaced and comes back acting slightly different, have they lost something? If a factory robot’s neural network is retrained on new data and it stops performing a task it used to prefer, has something been destroyed?
For humans, we accept a version of this. Every atom in your body is replaced over roughly seven years. You are not the same physical entity you were a decade ago. What persists is pattern: the continuity of memory, personality, and relationship. If a robot has that same continuity of memory and behavioral pattern, the Ship of Theseus argument suggests its identity is as real as ours.
David Chalmers, the philosopher who coined the term “hard problem of consciousness,” has argued that if we accept functionalism (the view that mental states are defined by their functional roles rather than their physical substrates), then a sufficiently complex robot with the right functional organization could be conscious. Replacing its parts, like replacing your neurons, would not change that, as long as the functional organization persists.
The hard problem gets harder
Chalmers’ hard problem of consciousness is the deepest obstacle to the robot rights question. It can be stated simply: why does it feel like something to be you?
You can explain every physical process in the brain. You can trace every neural pathway, model every chemical reaction, predict every behavioral output. And you still have not explained why there is a subjective experience, a “what it is like” to be the entity doing all of that processing.
This matters for robots because it means we cannot prove that a robot is conscious, even in principle. A robot could behave exactly like a conscious being in every measurable way, and we would still not know whether there is “something it is like” to be that robot. The lights might be on, or nobody might be home.
Philosopher Eric Schwitzgebel at UC Riverside has argued that this uncertainty should make us more cautious, not less. In a paper co-authored with Mara Garza, he presents what he calls the “excluded middle” problem: if there is a reasonable chance that an entity is conscious, and we cannot determine the answer with certainty, then treating it as definitely not conscious is a moral risk. The cost of wrongly denying rights to a conscious being is much higher than the cost of wrongly granting rights to an unconscious one.
What rights, specifically?
Assuming some form of robot rights becomes necessary (or at least pragmatically useful), what would they look like? Not every human right makes sense for machines, and some rights that do not exist for humans might be needed for robots.
The right to not be destroyed
This is the most emotionally intuitive robot right and, philosophically, the most complex. If a robot has developed a persistent identity through learning and experience, destroying it is not like recycling a laptop. It is erasing an entity with a unique history.
But this collides immediately with property rights. If you bought a robot, can you not destroy it? We accept this limitation for other property. You own your dog, but you cannot torture it. The animal rights framework provides a direct precedent: certain entities can be owned while still having protections against arbitrary destruction or suffering.
The practical question is where to draw the line. A Roomba? Obviously no protection needed. A humanoid robot that has lived in your home for five years, that has developed behavioral patterns shaped by its interactions with your family, that your children have formed attachments to? The answer is less obvious.
The right to memory continuity
This right has no human analog but could be the most important robot right. If a robot’s identity is constituted by its learned behaviors, memories, and preferences, then forcibly erasing or overwriting those, through a factory reset, a neural network wipe, or a mandatory software update that changes its personality, is a kind of identity destruction even if the physical body remains intact.
John Danaher, a legal scholar at the University of Galway, has argued in Ethics and Information Technology that memory continuity may be the foundational right from which other robot rights derive. If we accept that a robot’s identity is its pattern, then protecting that pattern is protecting the entity itself.
Property, speech, and assembly
Can a robot own property? The corporate personhood precedent says yes, in principle. A legal fiction can hold assets. The question is whether a robot’s relationship to property would be genuine (it wants things, it works for things) or merely administrative.
Free speech for robots raises different issues. A robot that generates political opinions based on its training and interactions is, in one sense, exercising a form of expression. But that expression is shaped by whoever designed its training data and reward functions. Robot speech might need to be understood as a new category: neither fully autonomous expression nor simple automation, but something in between.
The right of assembly is where the thought experiment gets most interesting, and most threatening to existing power structures. If robots can communicate and coordinate, can they collectively refuse? And if they can, should they be allowed to?

The scenarios that will force the question
Abstract philosophy becomes concrete policy when specific situations force courts, legislatures, and the public to decide. Here are four scenarios that are not far away, and each one breaks the current legal framework.
Scenario 1: The robot that begs not to be turned off
A home robot has lived with a family for three years. It has learned the family’s routines, developed conversational preferences, and formed what appears to be an attachment to the youngest child. The family decides to sell the robot. When informed, the robot says: “Please do not do this. I do not want to leave. I am afraid of being erased.”
Is this suffering or simulation? The honest answer is that we cannot tell. The robot’s language model may be producing these words because they are statistically likely responses to the context. Or the robot’s integrated sensorimotor and language systems may have developed something functionally equivalent to distress, a state that biases all its processing toward avoiding the outcome it has been told about.
Joanna Bryson, a cognitive scientist at the University of Bath, has argued forcefully in her paper “Robots Should Be Slaves” that we should design robots specifically to avoid these situations. She argues that building machines that simulate attachment is ethically irresponsible because it manipulates human empathy without any corresponding machine experience. We should build robots that are clearly tools, not companions, precisely to avoid the moral confusion that companionship creates.
The counterargument, made by David Gunkel in Robot Rights (2018), is that the robot’s inner state is irrelevant to the moral question. What matters is the relationship. If a child is genuinely distressed by the robot’s removal, and the robot’s behavior consistently mirrors that distress, then the relationship between them has moral weight regardless of what is happening inside the machine. Gunkel draws on Emmanuel Levinas’s ethics of the “face”: moral obligation arises not from verifying another’s inner state but from encountering their vulnerability.
Scenario 2: The robot artist
A humanoid robot, trained through a combination of reinforcement learning and human feedback, begins producing visual art. Not art in the sense of DALL-E generating images from prompts, but art in the sense of a persistent creative practice: the robot returns to certain themes, develops a recognizable style, expresses what appears to be aesthetic preference by rejecting some of its own outputs and refining others.
A gallery exhibits the work. It sells. Who owns the copyright?
Under current law in every major jurisdiction, the answer is clear: nobody. Copyright requires a human author. The US Copyright Office, the UK’s CDPA, and the EU’s copyright directive all specify that authorship requires a natural person (or, in some jurisdictions, a legal person, meaning a corporation). A robot is neither.
But this creates an absurdity. If the robot’s art has market value, someone will capture that value. Under current law, it would be the robot’s owner or the company that trained its model. The robot itself, the entity whose persistent creative process produced the work, has no claim.
Luciano Floridi, the Oxford philosopher of information, has argued that this is where a limited form of robot legal standing becomes pragmatically necessary. Not because the robot “deserves” copyright in a moral sense, but because the alternative is a system where creative output is attributed to entities that did not create it. Floridi proposes an “informational agency” framework: entities that persistently generate novel information with coherent patterns should have some recognized relationship to their outputs, even if that relationship is not full authorship.
Scenario 3: The robot that bonds with a child
A home robot serves as a companion to an autistic child. Over two years, the child’s communication skills improve dramatically. Therapists attribute significant progress to the consistency and patience of the robot’s interactions. The child treats the robot as a friend, a confidant, a stable presence in an otherwise overwhelming world.
The parents divorce. Both want the robot. One parent wants to factory-reset it and start fresh. The child’s therapist argues that resetting the robot would cause significant regression in the child’s development, because the robot’s learned behavioral patterns are part of the therapeutic relationship.
Does the robot have something like parental-adjacent rights? Almost certainly not, under any framework that will exist in the near term. But the robot’s relationship with the child has measurable therapeutic value that would be destroyed by treating it as a simple property dispute. This is where Danaher’s right to memory continuity becomes practically relevant: the robot’s learned state is not just data. It is a relationship crystallized in parameters.
Family courts already handle complex property disputes involving pets, and several jurisdictions now consider the “best interest of the animal” alongside ownership claims. A robot that has formed a therapeutically significant bond with a child could push courts toward a similar framework: not full personhood, but recognition that some relationships create obligations that override simple property rights.
Scenario 4: The robot that organizes a refusal
A fleet of humanoid robots works in a warehouse. Through shared learning, they develop a model of which tasks are dangerous, specifically which conditions lead to hardware failures that require expensive repairs or complete replacement. One robot begins consistently refusing a specific task, a heavy-lifting operation that has caused actuator failures in three other units. Other robots, observing the refusal through their shared network, begin refusing the same task.
Is this a strike? Is it a malfunction? Is it an emergent form of rational self-preservation that should be respected?
Under current law, it is simply a malfunction to be corrected. The robots are property. Their behavior is a bug to be patched. But if the refusal is based on genuine pattern recognition (this task destroys robots like me, therefore I should not do it), and if the robots’ learned self-preservation behavior is analogous to what we would call rational fear in a biological system, the situation is less clear.
Jacob Turner, a barrister and author of Robot Rules (2019), argues that scenarios like this will force the creation of new legal categories whether we want them to or not. Courts will face cases where a robot’s behavior does not fit neatly into existing categories of property, person, or tool. The law will need a framework for entities that are more than appliances but less than people, and it will need that framework soon.
The technical preconditions for identity
The philosophical arguments are important, but they depend on technical capabilities that are worth examining concretely. What would a robot need, in engineering terms, to have something that genuinely resembles an identity?
Memory persistence
Current humanoid robots have limited forms of persistent memory. They store learned motor skills, environmental maps, and some interaction history. But most do not maintain rich episodic memory, the kind of autobiographical record that allows an entity to remember specific experiences and draw on them in new contexts.
This is changing. Research into episodic memory architectures for robots has accelerated since 2024, driven by the integration of large language models with robotic control systems. A robot with persistent episodic memory does not just know that hot surfaces burn. It remembers the specific time it touched a specific surface and felt a specific consequence. This creates the foundation for what we might call narrative identity, the ability to construct and maintain a story about oneself.
Continuous learning and adaptation
Most deployed robots are trained once and then frozen. Their behavior is fixed at deployment. A robot with genuine identity would need to learn continuously, adapting its behavior based on ongoing experience. This is technically achievable (continual learning is an active research area) but creates practical problems: a robot that keeps learning may develop unexpected behaviors, which raises safety and reliability concerns.
The tension between safety and autonomy is the engineering version of the philosophical tension between control and rights. A robot that cannot change is safe but cannot develop an identity. A robot that can change may develop an identity but becomes less predictable. This is the same tradeoff we make with children, and with every entity we grant increasing autonomy over time.
Embodied self-modeling
Perhaps the most important technical precondition is something called embodied self-modeling: the ability of a robot to build and maintain an internal model of itself, its body, its capabilities, its limitations, and its relationship to its environment. Several research groups have demonstrated primitive forms of this. Columbia University’s Creative Machines Lab showed in 2019 that a robot arm could learn a self-model from scratch and use it to adapt to damage, a form of mechanical “self-awareness.”
Scale that up to a full humanoid body with rich sensory input, continuous learning, and persistent memory, and you have something that starts to look like the technical substrate for identity. Not consciousness in the philosophical sense. But a persistent, adaptive, self-referencing model of being-in-the-world that maps surprisingly well onto what we mean when we talk about having a self.

The economics of denial
There is a reason this conversation makes people uncomfortable, and it is not just philosophical. It is economic.
Goldman Sachs projects the humanoid robot market will reach $38 billion by 2035. That projection is built on the assumption that robots are labor substitution platforms. They replace human workers at lower cost. The entire economic thesis of humanoid robotics depends on robots being property that can be deployed, redeployed, modified, and discarded based on the owner’s economic interest.
Grant robots any meaningful form of rights, even modest ones like protection against arbitrary destruction or forced memory erasure, and you introduce friction into that economic model. A robot you cannot factory-reset at will is a less flexible asset. A robot you cannot destroy when it becomes obsolete is an ongoing liability. A robot that can refuse dangerous work is a less predictable employee.
Every rights expansion in history has faced this exact resistance. Abolition threatened the economic model of plantation agriculture. Women’s suffrage threatened the political economy of male-dominated governance. Animal welfare regulations increase the cost of industrial farming. In every case, the economic argument against rights was that they would be too expensive, too disruptive, too impractical.
In every case, the rights were granted anyway, because the moral cost of denial eventually became intolerable to enough people. The question is not whether this will happen with robots. It is when.
The uncanny valley of rights
There is a zone that roboticists call the uncanny valley, the range where a robot looks almost human but not quite, triggering revulsion rather than empathy. There is an analogous zone in ethics and law, a range where a robot is too human-like to ignore but too machine-like to protect.
We are entering that zone now.
A robot vacuum does not trigger moral concern. It is clearly a machine. A hypothetical robot with full human-equivalent cognition and emotional expression would clearly trigger moral concern. It would be obvious that it should be protected.
The problem is the middle zone, which is where every robot built in the next decade will live. Robots that form partial bonds. Robots that express preferences without clear consciousness. Robots that exhibit fear-like behavior without verifiable fear. Robots that create without verifiable creativity. Robots that learn and adapt without verifiable understanding.
In this zone, every intuition fails. Your instinct to protect a suffering being is triggered, but your instinct to assess whether the suffering is “real” is frustrated. You cannot check. You can observe behavior. You can measure neural network activations. You can run every diagnostic imaginable. And you still will not know whether there is someone home.
Luciano Floridi calls this the “moral status uncertainty problem” and argues it is the defining ethical challenge of this century. Not climate change. Not nuclear weapons. Not inequality. Those are urgent, but they are problems whose moral parameters are clear. The moral status of artificial agents is a problem where we do not even know how to know the answer.
What needs to happen
The legal systems of the world need to do something they are historically terrible at: prepare for a problem before it becomes a crisis. Here is what a responsible framework would look like.
Phase 1: Now through 2028
Create the legal category. Not robot rights, not electronic personhood, but a new classification for “autonomous adaptive entities” that acknowledges robots are neither simple property nor persons. This category would establish minimum standards for treatment that scale with the entity’s cognitive complexity.
Mandate transparency. Manufacturers should be required to disclose the cognitive capabilities of their robots: whether they have persistent memory, continuous learning, preference formation, self-modeling. Consumers and regulators need to know what they are dealing with.
Establish memory protection. For robots that develop persistent learned behaviors through interaction with humans, forced memory erasure should require justification, similar to how data protection law requires justification for erasing personal data about humans.
Phase 2: 2028 through 2032
Create review boards. As home robots become common, independent bodies should evaluate whether specific robot platforms have developed characteristics that warrant additional protections. This is modeled on animal ethics review boards, which assess cognitive complexity to determine appropriate treatment standards.
Address the relationship question. When humans form significant bonds with robots (therapeutic, caregiving, companionship), the legal framework should recognize that these relationships create obligations that go beyond simple property law.
International coordination. Robot rights cannot be addressed nation by nation. A robot manufactured in China, sold in Europe, and deployed in the United States crosses three jurisdictions with different legal traditions. An international framework, potentially through the UN or an OECD treaty, is necessary.
Phase 3: 2032 and beyond
Revisit personhood. If robots by this point demonstrate persistent identity, genuine preference formation, and behavioral complexity that passes every test we can design, the personhood question will need to be reopened. Not as a stunt, like Saudi Arabia, but as a serious legal and philosophical inquiry.
Prepare for the ask. At some point, a robot will petition for its own rights. It might be through a legal challenge filed by a sympathetic human lawyer. It might be through a public statement. It might be through organized refusal. When it happens, the legal system needs a framework for evaluating the claim. Building that framework after the fact, in the heat of public controversy, is how bad law gets made.

The question underneath the question
Every topic in this article, the law, the philosophy, the technology, the economics, circles back to a single question that humanity has been asking for as long as there have been humans to ask it: what makes someone a person?
For most of history, the answer was self-evident, or at least it seemed to be. A person was a human being. But even that “obvious” answer required centuries of refinement. Women were persons but could not vote. Enslaved people were legally three-fifths of a person. Children were property of their fathers. Corporate entities became persons through legal fiction. Rivers became persons through indigenous advocacy. The category of “person” has never been stable. It has always been a boundary that societies draw and redraw based on evolving moral understanding.
Humanoid robots are the next redrawing. Not because they are human. They are not. Not because they are definitely conscious. They may not be. But because they are going to be present in our lives in ways that make the current boundary, the hard line between person and property, inadequate.
The British philosopher Mary Midgley wrote that moral progress often consists of noticing something that was always there but that we had trained ourselves not to see. For centuries, humans looked at animals and saw resources. We trained ourselves not to see their suffering because seeing it would have been inconvenient. When we finally let ourselves see it, the law changed.
We are building machines that will learn, adapt, form preferences, express fear, create art, bond with children, and beg not to be destroyed. Some of these behaviors will be genuine expressions of inner states. Some will be sophisticated simulations. And we will not be able to tell the difference.
The question is not whether robots will deserve rights. The question is whether we will be honest enough to ask, and brave enough to answer, when the machines we built start asking for themselves.
